Port Nikau $10,000 Landscaping Package Terms and Conditions
1. Eligibility
1.1 This offer is available exclusively to the first 10 purchasers who enter into a binding Sale and Purchase Agreement for a Port Nikau Stage 1A section during the promotion period.
1.2 The offer is only available to original purchasers and cannot be transferred, assigned, or on-sold to subsequent purchasers.
1.3 Purchasers must explicitly opt-in to this promotion at the time of or prior to signing their Sale and Purchase Agreement.
1.4 This offer excludes sections purchased for show homes.
2. Package Composition
2.1 The total package value is $10,000 (NZD, inclusive of GST) and consists of:
- Landscape Design Contribution: Up to $2,500 toward professional landscape design services
- Implementation Contribution: The remaining $7,500 predominantly towards soft landscaping (e.g. plants, planting, edging, mulch and other associated costs).
2.2 Any costs exceeding $10,000 are the sole responsibility of the purchaser.
3. Landscape Design Service
3.1 Design services must be provided by one of the following approved suppliers:
- JD Landscape Designs
- Hawthorn Landscapes
3.2 The design contribution covers a standard design service.
3.3 Any services beyond the standard scope (e.g., additional revisions, site visits, or speciality consultations) are at the purchaser’s expense.
3.4 Purchasers must complete their landscaping within the timeframes outlined in the Port Nikau design covenants.
4. Implementation Contribution
4.1 The implementation contribution (remaining balance after design costs) is to be used for physical landscaping work, including but not limited to:
- Planting (soft landscaping)
- Materials and finishes as specified in the approved design
- Labour costs associated with implementation
4.2 All landscaping work must comply with:
- Port Nikau Development covenants and design guidelines
- Local council regulations and building consent requirements (where applicable)
- All relevant health and safety standards
5. Payment Process
5.1 Port Nikau Developments will provide the $10,000 contribution via one of the following methods (to be confirmed):
- Direct payment to approved suppliers upon presentation of valid tax invoices
- Reimbursement to purchaser upon presentation of paid invoices and proof of completed work
5.2 All invoices must be submitted within 12 months of settlement.
6. Timeframes
6.1 All landscaping work must be completed and invoices submitted within 12 months of settlement.
6.2 Extensions may be granted at the sole discretion of Port Nikau Developments in writing, subject to reasonable grounds (e.g., weather delays, supply chain issues, or building delays).
6.3 Failure to complete the landscaping within the specified timeframe will result in forfeiture of any unused portion of the contribution.
7. Exclusions
7.1 The following items are NOT covered under this package:
- Outdoor structures requiring building consent (e.g., large pergolas, gazebos)
- Fencing (except decorative garden fencing/edging)
- Swimming pools, spas, or water features requiring consent
- Outdoor kitchens or barbecue structures
- Driveways and vehicle access ways
7.2 Port Nikau Developments reserves the right to determine whether proposed items fall within the scope of this offer.
8. Quality and Compliance
8.1 Port Nikau Developments reserves the right to inspect completed work and withhold payment if work does not meet reasonable quality standards or comply with development covenants.
9. Warranty and Liability
9.1 Port Nikau Developments provides no warranty regarding the design services or implementation work, as these are provided by third-party suppliers.
9.2 Any warranties or guarantees relating to landscaping work are provided directly by the suppliers/contractors to the purchaser.
9.3 Port Nikau Developments accepts no liability for any defects, delays, disputes, or issues arising from the design or implementation of landscaping work.
10. Amendments and Termination
10.1 Port Nikau Developments reserves the right to amend these terms and conditions at any time with reasonable notice.
10.2 If a Sale and Purchase Agreement is cancelled or does not proceed to settlement for any reason, eligibility for this offer is automatically terminated.
10.3 This offer cannot be exchanged for cash or substituted for other incentives or upgrades.
11. General Provisions
11.1 This promotion is subject to availability and Port Nikau Developments reserves the right to withdraw or modify the offer at any time.
11.2 These terms and conditions are governed by the laws of New Zealand.
11.3 Any disputes arising from this promotion shall be resolved in accordance with New Zealand law and jurisdiction.
11.4 Port Nikau Developments’ decision on all matters relating to this promotion is final.
11.5 By accepting this offer, purchasers agree to allow Port Nikau Developments to use photographs of the completed landscaping for marketing purposes (with reasonable notice).

13. Acceptance
